Objectives: Proving forcible sexual offenses (Zina bil-onf) within the Iranian criminal justice system faces significant challenges, where forensic medical opinions serve as crucial evidence. This study aimed to analyze the role of forensic medical assessments in establishing such crimes, focusing on their capacities and limitations throughout the judicial process.
Materials and Methods: This research adopted a descriptive-analytical method using library sources, legal documents, forensic reports, and selected court rulings. First, the legal and theoretical framework was examined, followed by content analysis of judicial decisions and forensic medical reports related to sexual offenses involving force.
Results: Findings revealed that forensic opinions often suffer from limitations due to delays in examination, the washing away of evidence, victims' non-cooperation, or lack of standardized interpretation protocols. However, in cases where timely examinations were conducted and physical and psychological evidence was properly documented, forensic assessments played a decisive role in confirming the presence of force.
Conclusion: Strengthening the procedural position of forensic medicine, developing detailed examination protocols, and providing specialized training for forensic experts and law enforcement can enhance the accuracy of establishing forcible sexual offenses and contribute to judicial integrity.
