fa سیاست جنایی، تقنینی و قضایی در باب ‌مسئولیت پزشک؛ مطالعه مروری در ‌نظام ‌حقوق کیفری ایران پزشکی قانونی Forensic Medicine توصيفی و ارزيابی Descriptive & Survey <p dir="RTL" style="margin-right:-2.3pt;"><span style="font-size:12px;"><span style="font-family:iransharp;"><strong>مقدمه: </strong>با عنایت به قوانین موجود می‌توان به چهار نوع مسئولیت پزشک اشاره کرد؛ اخلاقی، مدنی،کیفری و انتظامی. با توجه به دعاوی &rlm;مطروحه علیه پزشکان، اکثر شکایت‌ها در ایران، جنبه مدنی و مالی دارند و تعقیب کیفری یا انتظامی پزشک کمتر مطرح است. &rlm;هدف این مقاله مروری، بررسی مبانی و انواع مسئولیت‌های پزشـک بـا توجـه بـه قانون مجازات اسلامی بود.&rlm;<br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong><span dir="RTL"> در مـوارد تخلف پزشکی، پاسـخ کیفـری از طریق تعیین دیه یا ارش اعلام می گردد و هر چند از لحاظ قانونی دارای ماهیات </span><span dir="RTL">&rlm;</span><span dir="RTL">گونـاگون</span><span dir="RTL">ی اسـت، لیکن در ایـن موارد صرفاً جنبه مدنی دارد. با اتکاء به چنین نظریـه‌ای، مـی‌تـوان بـدون مراجعـه بـه دسـتگاه </span><span dir="RTL">&rlm;</span><span dir="RTL">قضا</span><span dir="RTL">یی به موضوع رسیدگی کرد و از طرح دعاوی در مراجع قضایی خـودداری نمود. سیاست جنایی، تقنینی یا قضایی و اجرایی </span><span dir="RTL">&rlm;</span><span dir="RTL">ممکن</span> <span dir="RTL">است</span> <span dir="RTL">همسو</span><span dir="RTL"> یا متفاوت باشد. بررسی ماهیت دیه، مقررات موجود و مقررات بیمه‌ای پزشکان می‌تواند ما را به ارایه </span><span dir="RTL">&rlm;</span><span dir="RTL">راهکارها</span><span dir="RTL">ی مفیدی هدایت نماید که هم برای جامعه پزشکی و هم جامعه قضایی و نیـز مـردم و همچنـین بیمـه مفیـد و مثمر ثمر </span><span dir="RTL">&rlm;</span><span dir="RTL">باشد</span><span dir="RTL">.</span><span dir="RTL">&rlm;</span></span></span></p> <p><strong>Introduction</strong>: Four types of liabilities of physicians can be noted regarding the existing rules; moral, civil, criminal, <strong>&lrm;</strong>and disciplinary. Regarding the lawsuits against physicians, most of the complaints in Iran have a civil <strong>&lrm;</strong>and financial aspect, and criminal or disciplinary prosecution of physician is less considered. The aim <strong>&lrm;</strong>of this review was to examine the basis and types of liabilities of physicians in accordance with the <strong>&lrm;</strong>Islamic Penal Code.<strong>&lrm;</strong><br> <strong>Conclusion</strong>: In cases of medical misconduct, the criminal response is announced through the appointment of blood <strong>&lrm;</strong>money or Arsh, and although it is legally of different kinds, in these cases, it has only a civil aspect. <strong>&lrm;</strong>Relying on such a theory, one can consider the issue without referring to the judiciary and ignoring <strong>&lrm;</strong>lawsuits in the judicial authorities. Criminal, legislative, or judicial and executive policy may or may <strong>&lrm;</strong>not be consistent.
